Last week, a judge heard testimony from public health officials and experts regarding a lawsuit brought against the state by vape shop owners who say that the temporary 4-month ban on the sale of vaping products is unlawful. Department of Public Health Commissioner Monica Bharel admitted during cross-examination that youth vaping was not an "emergency."
